Citizenship, residence and the application route

EU and EEA free movement rules may provide a basis for entry and residence, but the applicable conditions and dates still need checking. Whether the Agency of Family Law or a municipality examines the marriage conditions depends on nationalities and basis of residence.

Documentation is individual to the case. A civil-status certificate or registry document from a nationality or residence country is not universally required.

Documents assessed for your case

• Valid passports or accepted travel documents; an accepted national identity card may be used by an EU citizen
• Additional civil-status or residence evidence only where the actual application requirements call for it
• Final divorce or death documentation if either partner was married before
• Correct translation or legalisation of documents issued outside Denmark, where required

Where EU cases still need care

Free movement does not standardise civil registration. A German Aufenthaltsbescheinigung, an Italian certificato di stato libero and a Polish court divorce ruling are all handled differently, and some countries issue documents with a short validity period.

Residence outside your country of citizenship does not automatically require registry documents from both countries. We check which records are needed and any relevant expiry dates before you request them.
